Divorce in California
The divorce process in California begins with one spouse filing a petition and serving the other spouse. Either spouse must be a resident of the state for at least six months and a resident of the County where the petition is filed for at least 3 months. If the party receiving the petition files a response, the court will hold preliminary hearings to determine if the parties can agree on their own. The court may also grant temporary orders at this time.
Next, both parties have to make financial disclosures to the other for asset division and spousal support concerns. If the parties can agree on key issues like child custody & support, alimony, and asset division, they may create a settlement agreement for the judge to review and sign. If the parties cannot agree, the judge will hold a trial to litigate these issues.
